These Terms and Conditions ("Terms") govern your use of the Cloud Poppy website ("Site") and the purchase of products from Cloud Poppy ("Cloud Poppy", "we", "our", or "us"). By accessing our Site or purchasing from us, you agree to be bound by these Terms.

  • You are responsible for all activities conducted through your account.

Cloud Poppy reserves the right to suspend or terminate accounts that are used unlawfully, fraudulently, or in breach of these Terms.

3. Age Requirement

By using this Site, you represent that you are at least 16 years of age or that you are using the Site with the consent and supervision of a parent or legal guardian.

4. Sale of Goods

These Terms govern the sale of all products available through the Site, including but not limited to:

  • Hoodies

  • Sweatpants

  • T-Shirts

  • Accessories

  • Future product categories offered by Cloud Poppy

We make reasonable efforts to ensure product descriptions, colours, images, sizing information, and pricing are accurate. However, we do not warrant that all information on the Site is free from errors, omissions, or inaccuracies.

Product colours may vary depending on screen settings and device displays.

Cloud Poppy reserves the right to:

  • Refuse or cancel any order

  • Limit quantities purchased

  • Correct pricing or product errors

  • Discontinue products without notice

An order is not considered accepted until payment has been successfully processed and a confirmation has been issued.

5. Pricing and Payment

All prices displayed on the Site are in Australian Dollars (AUD) unless otherwise stated.

We currently accept payment through:

  • PayPal

  • Shop Pay

  • Apple Pay

By submitting payment information, you represent and warrant that:

  • You are authorised to use the selected payment method.

Cloud Poppy reserves the right to refuse, reverse, or cancel transactions suspected of fraud, unauthorised activity, or unlawful conduct.

6. Shipping and Delivery

Orders are generally dispatched within 1–4 business days, excluding weekends and Australian public holidays.

Estimated delivery timeframes are provided as a guide only and are not guaranteed.

Where available, Express Shipping may be offered at checkout for an additional fee.

Once an order has been prepared for shipment, a tracking confirmation will be sent to the email address provided at checkout.

International Orders

International orders may be subject to import duties, taxes, customs fees, or other charges imposed by the destination country.

These charges are the sole responsibility of the customer.

Cloud Poppy has no control over these charges and recommends contacting your local customs authority prior to placing an order.

Delivery Information

Customers are responsible for providing accurate shipping information.

Cloud Poppy is not responsible for delays, failed deliveries, or lost parcels resulting from incorrect or incomplete shipping details supplied by the customer.

Risk in the goods passes to the customer upon delivery.

7. Returns and Exchanges

Our Returns and Exchanges Policy forms part of these Terms.

Returns or exchanges may be accepted within 14 days of delivery, subject to the conditions outlined in our Returns Policy.

To be eligible for a return or exchange:

  • Items must be unworn, unwashed, and unused.

  • All original tags, labels, packaging, and any attached seals must remain intact and in the same condition as received.

  • Items must not be altered, damaged, stained, or otherwise unsuitable for resale.

Cloud Poppy reserves the right to refuse returns that do not meet these requirements.

Return shipping costs are the responsibility of the customer unless the item is faulty, damaged, or incorrectly supplied.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy available under the Australian Consumer Law (ACL) or any other applicable legislation that cannot lawfully be excluded.

Where goods are supplied with guarantees under the ACL, customers are entitled to remedies in accordance with those statutory rights.

9. Limitation of Liability

To the maximum extent permitted by law, Cloud Poppy, its owners, employees, contractors, affiliates, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use of the Site

  • Inability to access the Site

  • Purchase or use of products

  • Delays in shipping or delivery

  • Errors or interruptions on the Site

Where liability cannot be excluded by law, Cloud Poppy's liability is limited to the maximum extent permitted under applicable legislation.
